West End Avenue DUI arrest reduced to reckless driving.
The defendant was arrest for DUI after the arrest officer paced him traveling 40 mph in a 30 mph zone. The officer futher alleged that the defendant was slow to stop after the emergency equipment was activated, smelled of alchol, fumbled getting his license and had red blood shot watery eyes. The defendant refused the field tests due to a knee surgery and the chemical test. A plea to reckless driving was entered. Case No. 08-108. |
